Examples of Common DUI Defense Strategies

Motion To Suppress Evidence

One of the most successful defenses for your DUI charge would be that the officer in question did not have proper grounds to conduct the original traffic stop.  If the judge hearing your case is convinced of this though skilled motion practice, then your case can be dismissed without even going to trial.

Scientific Defense of Rising Blood Alcohol

With this defense, the law requires that your blood alcohol level is no greater than a level of .08% while you were behind the wheel.  The blood alcohol levels before and after driving are entirely irrelevant once you prove that when you were driving, your blood alcohol level was below the .08% threshold.

In most cases, you can have an expert testify on your behalf depending on the pattern of consumption in your case.  Even while you tested above the .08% threshold, your blood alcohol content, at the time you were driving, may have actually been below the threshold, thus ending in a dismissal.
